Important Notice
US2AU LLC operates an international personal import facilitation service under the BuzzBallz Australia brand. We are not a liquor retailer. We do not sell alcohol. We source and import products from US retailers on your behalf, as your authorised buying agent. By using this service you agree to these Terms of Service in full.
1. About Us
1.1 US2AU LLC ("we", "us", "the Company") is a limited liability company incorporated in the United States, operating the BuzzBallz Australia import facilitation platform.
1.2 We facilitate customer-directed personal imports of BuzzBallz products from licensed US retailers to Australian addresses. We do not manufacture, wholesale, or retail alcohol. We do not purchase products for resale.
1.3 Physical handling, customs clearance, and last-mile delivery in Australia is carried out by Vosy Logistics, an independent Australian logistics contractor engaged by us on your behalf.
1.4 These Terms of Service govern your use of our website and platform. They should be read together with our Personal Import Agency Agreement, which governs the specific legal relationship between you and us in respect of each import transaction.
2. Eligibility
2.1 You must be 18 years of age or older to use this service. It is an offence under Australian law to purchase or procure alcohol for a person under 18.
2.2 By placing an import request, whether as a registered user or a guest, you declare that you are 18 years of age or older.
2.3 This service is available to Australian residents only. We deliver to Australian addresses only.
2.4 You must provide accurate personal information when placing an order. We reserve the right to cancel any order where we have reason to believe the information provided is false or misleading.
3. Nature of the Service
3.1 When you submit an import request through our platform, you are not purchasing alcohol from us. You are instructing us to act as your buying agent to source and purchase the specified products from a licensed US retailer on your behalf.
3.2 Title to the goods passes to you at the point of US retail purchase. We never own the goods. Vosy Logistics never owns the goods.
3.3 Vosy Logistics acts as your authorised customs agent under section 33 of the Customs Act 1901 (Cth). It lodges import declarations, acts as importer of record, and pays duties and taxes on your behalf.
3.4 The full legal framework governing each transaction is set out in the Personal Import Agency Agreement, which you must accept before any order can proceed.
4. Import Requests
4.1 An import request is not confirmed until you have completed the checkout process, accepted the Personal Import Agency Agreement, completed all mandatory acknowledgements, and payment has been successfully processed.
4.2 Once your import request is confirmed, we will purchase your specified products from a licensed US retailer. We do not pre-purchase stock. Every purchase is linked to your specific confirmed order.
4.3 Product availability is subject to stock availability at US retail outlets. In the event that a product becomes unavailable after your order is confirmed, we will contact you to discuss alternatives or arrange a refund of all amounts paid.
4.4 We reserve the right to decline any import request at our discretion, including where we have reasonable grounds to believe the order is not for personal use, the quantity ordered is inconsistent with personal consumption, or the order may breach any applicable law.
5. Mandatory Acknowledgements
5.1 Before any import request can proceed to payment, you must individually confirm all of the following:
- Service nature — this is a logistics and sourcing facilitation service, not a sale of alcohol
- Ownership — you own the goods from the moment of US purchase
- Customs agency authority — you appoint Vosy Logistics as your authorised s.33 customs agent
- Duties and taxes — you accept personal liability for all applicable government charges
- Personal use only — the goods are for your personal consumption and will not be on-sold
- Age confirmation — you are 18 years of age or older
- Full agreement — you accept these Terms of Service and the Personal Import Agency Agreement in their entirety
- Delivery timeframes — I understand that delivery may take up to 28 business days and that delays caused by international freight or Australian customs are outside US2AU LLC's control. I will not initiate a payment dispute or chargeback solely on the basis of a shipping delay where my order is still in transit.
5.2 All acknowledgements are recorded with a timestamp. No order will proceed unless all eight acknowledgements are completed.
6. Pricing
6.1 All prices are displayed in Australian dollars.
6.2 Your total cost is made up of the following components, each itemised separately before you confirm your order:

6.3 We do not earn any revenue from product cost, freight, duties, or GST. These are genuine pass-throughs remitted in full to the relevant party.
6.4 Duty rates are set by the Australian government and are subject to change. The excise-equivalent duty rate is CPI-indexed and adjusted twice annually. The rate applicable at the time of your import clearance applies.
6.5 The total amount payable is displayed clearly before you confirm your order. By confirming, you agree to pay the total amount shown.
7. Payment
7.1 We accept payment by credit card, debit card, and PayPal.
7.2 Payment is processed securely through our payment provider. We do not store your full card details.
7.3 Your payment must be successfully processed before your import request is confirmed and any US purchase is made on your behalf.
7.4 All charges will appear on your statement as US2AU LLC or BuzzBallz Australia. If you have any questions about a charge, contact us at us2auimports@gmail.com before initiating a dispute with your bank or payment provider.
8. Delivery
8.1 Estimated delivery timeframes are indicative only. Delivery times depend on US retail processing, international freight schedules, and Australian customs clearance, none of which are entirely within our control.
8.1A Orders may take up to 28 business days from the date of confirmed payment to arrive at your nominated Australian address. This timeframe accounts for US retail processing (1–3 business days), international freight (7–14 business days), and Australian customs clearance (1–7 business days). These are estimates only and are not guaranteed.
8.1B Customs clearance is conducted by the Australian Border Force, an independent government authority. We have no control over the timing or outcome of customs processing. Delays caused by customs inspection, examination, or additional documentation requests are outside our control and do not constitute a breach of our obligations.
8.1C You acknowledge that international shipping and customs clearance timeframes are inherently variable and that estimated delivery times are not guaranteed delivery dates. We are not liable for any loss or inconvenience caused by delays in transit or customs clearance.
8.2 Delivery is arranged by Vosy Logistics via a licensed courier to your nominated Australian address.
8.3 An adult signature and identity verification (18+) is required at the point of delivery. If no eligible person is available to receive the delivery, redelivery arrangements will be made by the courier. We are unable to authorise goods to be left unattended.
8.4 We do not deliver to PO boxes or freight forwarding addresses.
8.5 Risk of loss or damage passes to you upon delivery and acceptance by you or your authorised recipient.
9. Cancellations and Refunds
9.1 You may cancel your import request at any time before we have executed the US retail purchase on your behalf. To cancel, contact us immediately at us2auimports@gmail.com.
9.2 Once the US purchase has been executed, the goods are legally yours and the purchase cannot be reversed. We are unable to offer a refund of the product cost once the US purchase has been made.
9.3 Our service fee is non-refundable once the US purchase has been executed.
9.3A A shipping delay alone does not entitle you to a refund or cancellation once the US purchase has been executed. If your order has not arrived within 35 business days of your confirmed payment date, contact us at us2auimports@gmail.com and we will investigate with our freight and logistics partners.
9.4 If your goods arrive damaged or there is a shortfall in your order, contact us within 5 business days of delivery at us2auimports@gmail.com. We will work with Vosy Logistics and our freight partner to investigate and resolve the issue.
9.5 Nothing in this clause limits any rights you may have under the Australian Consumer Law that cannot be excluded by contract.
10. Prohibited Conduct
You must not use this service to:
- Procure alcohol for a person under 18 years of age
- On-sell, wholesale, or commercially distribute imported goods
- Import goods for any purpose other than your own personal consumption
- Provide false or misleading information in connection with any order or agreement
- Place orders in quantities inconsistent with personal use
- Attempt to circumvent our age verification or acknowledgement processes
Breach of any of these prohibitions may result in immediate cancellation of your order, suspension or termination of your account, forfeiture of any amounts paid in respect of an executed purchase, and referral to relevant Australian authorities where required by law.
11. Intellectual Property
11.1 All content on this platform, including the BuzzBallz Australia brand, website design, text, and images, is owned by or licensed to US2AU LLC. You may not reproduce, distribute, or use any content from this platform without our prior written consent.
11.2 BuzzBallz is a product of Southern Champion LLC. US2AU LLC is not affiliated with, endorsed by, or acting as an agent of Southern Champion LLC or BuzzBallz. We source BuzzBallz products from licensed US retailers in the open market.
12. Privacy
12.1 We collect personal information — including your name, address, date of birth, and order history — for the purposes of providing the service, complying with Australian customs requirements, and verifying your age.
12.2 Your information may be shared with Vosy Logistics, our freight partner, and Australian customs authorities as required to fulfil your import request.
12.3 We handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our full Privacy Policy is available at [link].
12.4 By using this service, you consent to the collection, use, and disclosure of your personal information as described in this clause and in our Privacy Policy.
13. Limitation of Liability
13.1 To the extent permitted by law, our total liability to you in connection with any order is limited to the service fee paid by you for that order.
13.2 We are not liable for any indirect, consequential, or special loss arising from your use of this service.
13.3 We are not liable for delays, loss, or damage caused by US retailers, freight providers, customs authorities, or events beyond our reasonable control.
13.4 Nothing in these Terms excludes any liability that cannot be excluded under the Australian Consumer Law.
14. Changes to These Terms
14.1 We may update these Terms from time to time to reflect changes in our service, legal requirements, or operational arrangements.
14.2 We will notify you of any material changes by email before they take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms.
14.3 The current version of these Terms is always available on our website. The version number and date at the top of this document indicates when it was last updated.
15. Termination
15.1 We reserve the right to suspend or terminate your access to the platform at any time if you breach these Terms, provide false information, or conduct yourself in a manner that we reasonably consider harmful to the service or other users.
15.2 You may stop using the service at any time. If you have a registered account, you may request deletion of your account by contacting us at us2auimports@gmail.com.
16. Governing Law
These Terms are governed by the laws of Australia. The parties agree to submit to the non-exclusive jurisdiction of the Australian courts in respect of any dispute arising under these Terms.
Nothing in this clause limits any rights you may have under the Australian Consumer Law, which applies as a matter of mandatory federal law regardless of any governing law provision.
